USCIS advised not to file H-1B till further notice

USCIS advised employers to not to file H-1B petitions until new Guidance are issued.

The new H-1B legislation which goes into effect on March 9, 2005 allowing cap exempt H-1B filing by U.S. master's or higher degree holders until the guidance is published in the federal register. Any such cases which are submitted not in compliance with the instructions under the to-be-published federal register and before the effective date of the federal register will be rejected and returned.

The announcement did not specify the date when such guidance will be published.
