Revised Form I-765, Application for Employment Authorization, is now available. USCIS recently published the revised Form I-765 with an edition date of 02/13/15. Changes made to Form I-765 include the addition of the eligibility category (c)(26) for certain H-4 dependent spouses to apply for employment authorization, following the new rule allowing H-4 visa holders to apply for EAD, which recently became effective May 26, 2015.

H-4 dependent spouses applying for EAD can download the revised Form I-765 on the USCIS forms page. Although versions of I-765 with edition date 05/27/08 or later will still be accepted, H-4 EAD applicants are encouraged to submit the revised Form I-765 to avoid delays in their application.

When completing the revised Form I-765, H-4 applicants must provide the receipt number of their H-1B spouse’s most recent Form I-797, Notice of Approval.
