February 2023 Visa Bulletin Results & Analysis

The February 2023 Visa Bulletin has been released, and the results are disappointing. Unfortunately, there is no movement in final action dates or dates for filing applications for any category under employment-based visas. The only forward movement is in the F1 family-based category for Mexico, which advanced by 4 months and 16 days.

No update was given in regards to the EB2 category for India and its progress – however, there are some updates regarding the EB3 “Other Workers” category that may affect the progress of India’s EB3 category.

Similar to the January 2023 Visa Bulletin, February brings no forward movement across the board with the exception of the F1 Mexico category, advancing by 4 months and 16 days. No movement in the first two visa bulletins of the 2023 calendar year is definitely disappointing for those who are waiting patiently for their priority date to become current.

The USCIS also included the following updates:

  • They may establish an F2A final action date in March to ensure number use is within the annual limit.
  • Higher than expected applications in the Employment Third Preference “Other Workers” (EW) have caused more retrogression for both the worldwide final action date and application filing date. Except for China and India, all countries are subject to a final action date of January 1, 2020 and an application filing date of February 1, 2020.
  • The Employment Fourth Preference Certain Religious Workers (SR) category has been extended until September 30, 2023. It is subject to the same final action dates as the other Employment Fourth Preference categories.

One thing to monitor is the higher than expected applications in EB3 for “Other Workers” – this may affect the progress of India EB3. It seems that the employment-based category of visas is growing exponentially for all countries and categories.

Unfortunately, there isn’t much more to report on when it comes to the February 2023 Visa Bulletin. We will certainly follow updates closely and stay informed regarding any progress made with pending green card applications in hopes that March will bring better news.
