January 2023 Visa Bulletin: No Movement for India EB2 or EB3

The January 2023 Visa Bulletin has been released by USCIS, and no forward progress has been made for any category on the bulletin. For those interested in the India EB2 and EB3 categories, the good news is that there is no retrogression for January 2023. However, no movement forward may give a grim outlook for the rest of the new year.

January 2023 Visa Bulletin Analysis

As expected, India EB2 and EB3 did not see any movement in the most recently released visa bulletin. It appears that the backlog is still being worked through, and that dates are staying at a standstill due to fears that the USCIS will go over their quota cap for fiscal year 2023.

There was actually no forward movement whatsoever for any category or country for January’s bulletin. However, there was change for both China and India in the EB1 category. As warned in the December 2022 Visa Bulletin, the USCIS was considering enacting a final action date and a date for filing for both categories to ensure that they are holding their number use within the annual allowed for fiscal year 2023. This means that rather than India and China EB1 staying current, applicants from China and India are subject to a final action date of February 1, 2022 and an application filing date of June 1, 2022.

The USCIS did not make any other comment in regards to the employment second or third categories in this visa bulletin as they have been for the past couple of bulletins. We can just assume that they are still working through the backlog, and that there will be more clarity on the future of India EB2 and EB3 as we move into the new year. However, no retrogression is definitely a good sign that the dates will only trend forward from here on out.
