The USCIS is now implementing premium processing for EB1 and EB2 petitioners who have a pending filed Form I-140, Immigrant Petition for Alien Workers. This will specifically apply to certain previously filed forms that are listed under:

• E13 – Multinational Manager and Executive, or
• E21 – Member of the Professions holding an Advanced Degree or an Alien of Exceptional Ability (Not seeking a National Interest Waiver).

If you fit the classifications listed above and have a pending filed Form I-140 for EB1 or EB2, you can request a premium processing upgrade by filing a Form I-907, Request for Premium Processing Service. 

Here are the phases that will occur for the expansion: 

• June 1, 2022 – USCIS will accept Form I-907 requests for E13 multinational executive and manager petitions received on or before Jan 1, 2021. 

• July 1, 2022 – USCIS will accept Form I-907 requests for E21 petitions received on or before June 1, 2021, and E13 petitions received on or before March 1, 2021. 

The USCIS has stated in their press release on the matter that they will reject premium processing requests for E13 and E21 that have been filed before their start date of June 1, 2022 or July 1, 2022. They are not accepting new initial Forms I-140 with a premium processing request. 

Please note

there was a new version of Form I-907 published by USCIS, which is dated May 21, 2022. For the month of June, the new and old edition, dated September 30, 2020, will be accepted. However, only the updated Form I-907 will be accepted starting July 1, 2022.

The current premium processing fee is $2,500 if you are filing Form I-140 requesting EB1, EB2, or EB3 immigrant visa classification.

This expansion of premium processing is to help increase the USCIS efforts in getting through the visa backlog as quickly as possible. We hope this will aid the efforts and give those who currently are waiting for EB1 or EB2 processing with E13 or E21 classifications a faster turnaround time.
