The USCIS is now implementing the next phase of premium processing expansion for those who have pending Form I-140, Immigrant Petition for Alien Workers, under EB-1 or EB-2.
The USCIS previously announced their expansion of premium processing to additional form types in order to help speed up processes and make the immigration system more efficient. This expansion will be in phases and will continue with the premium processing availability of additional Forms I-140, Form I-539, and Form I-765 as announced.
This is the third phase of the expansion, and similar to the first and second phases, this phase also only applies to certain previously filed Form I-140 petitions under an E13 multinational executive and manager classification or E21 classification which denotes a member of professions with advanced degree or exceptional ability seeking a national interest waiver.
If you would like to request premium processing, file Form I-907, Request for Premium Processing Service, with the USCIS. The USCIS will accept premium processing requests beginning on September 15, 2022 for the following categories:
- E13 multinational executive and manager petitions received on or before Jan. 1, 2022; and
- E21 NIW petitions received on or before Feb. 1, 2022.
Note:Any premium processing requests for dates that show a receipt after the dates listed above will be rejected. The USCIS is not accepting new Forms I-140 with premium processing requests at this time.
