H1B Visa Under Administrative Process

Posted by Prakash Manikwar On 07 Jan 2011

I had my interview for H1-B visa on Dec 8th 2010 in Hyderabad and was mentioned that my application is under administrative process (I guess it is under 221g). I have submitted all the necessary documents 4 days prior to the interview. I have been in the US for 8yrs on F-1 student visa and this was the first time I have applied for the H1-B. I have been given a case number and a website to check the update. My case status on their website has always been under processing. It says:

"Your case is currently undergoing processing. Please continue to check this website for updates on the status of your case. Any new information received will be posted to the website".

Does anyone know how long this process generally takes?

I also attended on Jan,4th 2011.for me also they have issued same 221g which is under administrative process .in that it was mentioned "you may check after one week your status" using case number.i am checking in the following link.http://hyderabad.usconsulate.gov/pending-or-refused-visas.html,but it is always showing as "we r not able to identify ur case number...etc." .usually how many days it will take to get the status and overall how many days take for final decision.

can u update me how many days it will take initially to publish status.

    • Posted by Prakash on January 11 2011 at 10:00am

I'm not sure how much time it takes to publish online. In my experience if you have proper documentation you should receive your visa in 35-40 days. This is true atleast if you are applying from Hyderabad consulate. I'm not sure about the wait time in other places.
      Good luck,

      Hi Anil,
I read your posts above. I attended my H1B visa renewal interview on 3rd Jan and my case is similar to yours (gave white slip for admin processing and no documents requested, consulate retained my passport). I'm still waiting for updates and I was able to see my case number showing as "under processing" in this link - http://hyderabad.usconsulate.gov/pending-or-refused-visas.html. You can also check the VFS website - https://www.vfs-usa.co.in/ApplnForms/TrackYourPassport.aspx

I have been in a similar situation. I had my H1B visa interview in New Delhi on Dec 22nd 2010. Like you, I got a case number too along with a pink colored form. I started checking my status around 29th of Dec. as I wasn't expecting my administrative processing to finish within a weeks time. I have been regularly checking for update on my case status on the newdelhi embassy website. And for you it has to be on the Hyderabad consulate's website. I ve made numerous calls/emails to VFS. contd

    • Posted by Hullas on January 24 2011 at 12:37am

I ve made numerous calls/emails to VFS. This is because, like you, I couldn't get any updates on my status too. I would get the annoying message like u are "not able to identify case number "I did get a reply from US embassy via VFS confirming that the case number I was typing was indeed a correct number. I replied back, asking them to update my case number in their records. This morning (24th Jan) I could see their system accepting my case number. It says - case under admin processing. contd

    • Posted by Hullas on January 24 2011 at 12:39am

Typically, it should not take this long for the case number to be registered in the embassy/consulate's system. The US embassy website lists case numbers are updated twice a week. For some reason they did not update my case number and I think the same thing is happening to you. Since I got to see my case number in their records today, my advice -- stay patient and there's nothing else you can do. Your case number will show up in a few days time too. Surprising, this doesn't happen to everyone.

Dont loose your confidence guys, I got the 221g in june 2008 and I waited for almost 5 months and got the stamping on nov. It depends upon the type of RFE and the time taken for them to verify. it differs. They will say 4- 8 weeks but thats not the final..If the docs provided are genuine then no need to worry. PRAY AND WAIT as that's not in out hands

How long is taking for the administrative processing to complete? My situation is similar to Praksh. I had my visa interview at Delhi on 23'rd Dec. I am able to check my status and it shows under administrative processing.

The Delhi embassy has been giving error for the last few days, after i enter my case number. Not sure if others are also facing similar issues.

Prasad, Could you please tell us how many days it took for you to get the passport back with Visa stamp (from the day of the interview)??

    • Posted by Prakash on January 31 2011 at 11:38am

It took me 35 days at HYD consulate.

      Thanks Prakash.

Anil, did you get any updates on your case?

Anand, did you get your Visa?

I went for my H1 b visa stamping in mid of Oct 2010. I was given an yellow form and to submit documents related to my employer. I submitted on the same day. Since then whenever I check the http://hyderabad.usconsulate.gov/pending-or-refused-visas.html. It shows that they are not able to identify Case #. I emailed, called VFS they said the case number was correct. I even called the DOS to check if something was missing. All they could say was that the case was in Administrative processing.

Hi I had my visa stamping one month back and was given a pink slip. It can be because of a common muslim name I have. All my docs are fine and thy retained my ppt. Thy told that I am qualified for the VISA but admin processing to be done. Can anyone give me light on how much time it takes when it is common muslim name issue...
      Thanks in advance

    • Posted by Prakash on May 12 2011 at 6:57am

I'm sure no one has an absolute answer for your question. It looks like they go case by case, complete processing time could be anywhere between 3 weeks to few months.
      Good luck to you.

      Thanks for the reply prakash,

Now my status showing as case processed. What it means?

    • Posted by nahtan on June 22 2011 at 2:29am

Applied for H1B stamping at Chennai consulate:
      Applied: 3rd June, 2011 --> Admin processing
Notification of visa approval from VFS: 22nd June, 2011.
In total, about 20 days (fewer working days).

My wife and I were in the same situation few months ago. We went to South America for only three days to get our visas stamped, and when we were at the embassy, the person who was working with our case told us to wait... We were waiting for like 45 minutes and then she called us and told us the (most terrifying words) "You are in Administrative Process"... She said they will call us when everything were ready, she didn't even hold our passport. My wife asks how many days and they said like 3 weeks. Devastating, that's how we felt walking out from the U.S. Embassy, not knowing what the future had prepared for us. During that time we were living in my mom's living room sleeping on a couch. After three long weeks without notice we began researching and realized that the period of time that normally takes the process is between 3 MONTHS up to 1 year (No weeks, the lady gave us a wrong period of time by "mistake"). That was when our entire world began to fall down even worst. While stuck in South America, we were paying the rent of our apartment, and all the bills as if we were living in U.S, plus my employer gave me an Unpaid Leave of Absent vacation (meaning NO MONEY). Forgot to mention we also had to cover all the living expenses of our forced "vacations" in South America. We were not even allowed to reenter the U.S to pick our belongings (Remember we were expecting to spend 3 days, so we only had a carry on bag with us). Our car was at the Airport parking lot the whole time, $18 per day, you get the math. That was such a long time of waiting, issues, stress, anger, fighting, disappointment, anxiety, and nervousness. But guess what!!! Exactly 90 days after our appointment at the U.S Embassy we received the long waited E-mail from them notifying that the process was ended and then we should go there with our passports!! Wow we were so happy to receive that E-mail; I still remember hugging my wife and crying of happiness now knowing we were going to get our life back. When in the embassy they just took our passport and after 1 week we received the visa.

If it happens you're reading this right now, you're probably looking for answers. My advice to you people who are in that case is just to stop being negative, take it easy and make a plan to be living out of the U.S for at least 3 months. Remember, once you're told to wait there's NOTHING you can do to change or rush this process. Lawyers, representatives, governments, employers, or friends working inside the embassy, no one can help you out. In my research I found that the 80% of the cases are resolve in 3 months (Unless they find something inappropriate in your history case). I know the wait won't be easy but DON'T MAKE IT WORST by been negative and sad. Enjoy your "vacation" time, do productive things to your life. Another thing, DO NOT CALL the Embassy, they won't give you any relevant information because they don't even have you paper work. Administrative process means that your paper work has been sent to an agency in the U.S (most likely FBI) to do a background check on you. Some consulates have an online system in where you can find info about your status, but only expect to see two things "In process" and "Ended", that's all about it. You can E-mail them (I did) but they will not give you any important info on your case so don't waist your time. The good news, for those H1B visa, you can always try to make a special deal with your employer to let you work from home during time out. This Adm. Process almost destroyed my life, don't let that happens to you, now days I'm back in the U.S working and I feel blessed for all the good things I have in my life.

Hope this helps to cheer you up in those moments of hopeless, keep up your faith and hope to see you back in the new world in few months.

i was appeared for interview on 21 dec. Good documentation is the words of visa officer, but she does not give me any color paper, just kept my pasport and doc by telling that after an admint proc?

    • Posted by Prakash on December 22 2011 at 8:51am

They did tell me same thing. My suggestion to you is to wait, as they kept your passport they will send it to you after their process is complete.

      Good luck.

i have attended my h1b visa interview on Jan5th in Hyderabad consulate.

after the interview he took my pass port and gave blue slip

how many days processing will take i don't have any updates from last two weeks

      need some help

    • Posted by dinga on March 22 2012 at 2:42am

I had got 221g too in Jan 2011. The vfs site says, "we r not able to identify ur case number...". All I can do is wait.

Hyderabad cons. issues the most 221g admin processing...
      Mumbai & Delhi issue lesser.
      Chennai consulate issues the least.

So guys, the next time you do the booking for H1B visa interview, do it at Chennai consulate.

    • Posted by Jagdish on March 29 2012 at 12:43pm

      Hi Dinga,

I too got the same on march 14th and my status shows as "Your case is currently undergoing processing. Please continue to check this website for updates on the status of your case. Any new information received will be posted to the website.

Any idea how long will it take??

      Please update?

    • Posted by Raz on June 19 2012 at 11:41am

OK so here's my story. This should help. I was issued an i797 in Oct2009 & in Nov2010 I went on vacation & scheduled my interview in New Delhi. I had a backpack full of docs but the consular did not even ask for a single one. All he asked was how long have I been in the US and what company I work for. My AP took 5 months. They gave me a pink 221g with a ref # on it which I would use to check status. They would not entertain any calls but would reply to emails. In Apr2011 I flew back to the US.

    • Posted by Raz on June 19 2012 at 11:51am

In addition, they were gonna hold on to my passport but I told them I had a business trip coming up so they returned the passport to me and told me to deposit it once the AP is done. Fortunately, I had already briefed my managers that i MAY get stuck so they had agreed to let me work from home. So i was getting paid, but my apt & bills in the US were running. My advice, enjoy the time while you're there coz you cant do anything about AP but wait and be patient. Try and work from home if you can.

but whenever I write the case number, it disaplys that please check your case number. what does it mean actually and how much time it will take to issue the visa.

It takes sometime for your case to appear in their system, you can check it online probably after a week or so. They will update the status perodically.
