December 2022 Visa Bulletin Predictions

The December 2022 Visa Bulletin is likely to be released next week on Tuesday, November 8 or Wednesday, November 9. Let’s discuss what experts are predicting for this upcoming Visa Bulletin and whether or not we can expect to see any movement in key categories. 

In the Trackitt forum on the subject, many visa applicants have priority dates that are late in 2012 and beyond and are hoping that some movement will be made within the next couple of months. However, due to the results of the November Visa Bulletin and comments added to the last release by USCIS and the State Department, the immediate future of India EB2 and EB3 categories is uncertain.

December 2022 Visa Bulletin Predictions

In the November 2022 Visa Bulletin, there were no changes seen to the priority dates for both India EB2 and EB3. At this time, the consensus among many different trusted sources is that we will not see any priority date movement for India EB2 or EB3 in December’s Visa Bulletin release. 

This is due to a number of reasons, including the November Visa Bulletin note that mentioned the possibility of a universal Final Action Date being established for all chargeability for EB2. This means that there is an increased demand for visas in the employment second category all across the world. This also means that there is likely none or very little unused visa spillover for India from other countries in the EB2 category. 

For the India EB3 category, the future may look a little brighter depending on the amount of interfiling from EB3 to EB2. This could relieve some of the pressure on EB3 and allow it to make a small push forwards. However, if EB3 does move in December, it would likely only be by roughly 1 month.

Is Another EB2 Retrogression Likely?

It does appear that an EB2 retrogression in the near future wouldn’t completely be out of the question. However, no data has been revealed that would support this at this time. As of right now, the huge retrogression we saw in the Visa Bulletin of October 2022 for India EB2 has set the starting point for the rest of the fiscal year 2023.

We believe we won’t see any movement in India EB2 until March or April of 2023. India EB3 is slightly less clear, but may see a small amount of movement sooner than that – likely in January of 2023.
