The H-1B Visa Fiscal Year (FY) 2025 season starts this week as registrations will be accepted online beginning March 6th 2024. The forthcoming H-1B season is set to witness significant changes in its lottery predictions, impacting prospective applicants.

Last year, the FY 2024 season saw a staggering 781,000 H-1B registrations, raising concerns about potential abuse within the system. Shockingly, over 108 applicants each submitted at least 25 registrations, prompting questions about the authenticity of job offers.

The H-1B visa program has faced abuse in recent years, with loopholes allowing bad actors to exploit the system by submitting multiple registrations without genuine job offers. Amid these challenges, the U.S. Citizenship and Immigration Services (USCIS) is taking steps to address fraud, leading to changes in the H-1B lottery selection process for the FY 2025 season. The focus is on reducing abuse and ensuring a fair and transparent system.

Revamping the Lottery Selection Process

To curb fraudulent practices, USCIS has revamped the H-1B lottery selection process. Starting from the FY 2025 season, applicants are required to submit their Passport Number or Travel Document Number. This move aims to discourage the submission of multiple registrations by a single individual and streamline the selection process.

Past Few Years’ H-1B Filing Trend:

The previous years’ H-1B registrations and lottery results have helped the USCIS weigh where there are gaps in the system and which procedures call for a change. 

Changes to H-1B Lottery Selection Process:

As we briefly mentioned before, USCIS proposed a rule on H-1B program modernization in October 2023, leading to a final rule altering the lottery process for FY 2025. Applicants are now required to submit passport or travel document numbers, discouraging multiple registrations.

Despite a consistent increase in filings each year, changes in the lottery selection process for FY 2025 are anticipated to reduce registrations, possibly by around 350,000 compared to the previous year.

Status of US Economy, H-1B Job Market:

While the U.S. GDP growth rate is a commendable 3.2%, and the unemployment rate remains stable at 3.7%, the H-1B job market doesn’t mirror this optimism. A 23% decrease in H-1B jobs since 2022 suggests minimal hiring by tech companies, potentially leading to lower H-1B registrations.

F1 Visa Students in the US: Studying, OPT, STEM OPT:

International student enrollment in the U.S. has increased by 11%, with F1 students on OPT and STEM OPT contributing significantly. With approximately 198,000 international students on OPT and an expected 240,000 STEM OPT applicants, an upswing in registrations from this group is anticipated.

H4 Visa Holders, L1 Visa Holders:

H4 visa holders face challenges due to PERM processing delays, driving them to seek H1B visas for work opportunities. Similarly, L1 visa holders, restricted from company transfers, may contribute to increased H-1B registrations.

Previous H-1B Applicants:

Persistence is a hallmark of those aspiring to work in the U.S. Applicants who previously missed out on the H-1B lottery are likely to try again, facilitated by the ease and affordability of the online registration system, costing only $10.

Last Chance with Low H-1B Registration Fee for FY 2025:

Although a fee increase to $215 is on the horizon from April 1st, 2024, the current season retains a $10 registration fee. This last chance at a lower fee may encourage more registrations, particularly from IT body shops.

Predictions and Timelines

Considering the complex interplay of these factors, predictions range from 420,000 to 500,000 H-1B registrations for the FY 2025 season. The altered lottery selection process aims to make the distribution more equitable.

  • Registration Start Date: March 6th, 2024, 12 Noon EST
  • Registration End Date: March 22nd, 2024, 12 Noon EST
  • Lottery Results: Any time after March 25th, but before March 31st, 2024
  • Petition Filing Start Date for Initial Selected Applicants: April 1st, 2024
  • Petition Filings End Date for Initial Selected Applicants: June 30th, 2024
